Real Estate Transaction Assistance
Studio Scheel provides comprehensive support throughout the real estate transaction process, assisting both property owners (sellers) and potential buyers. The set of technical services offered falls under the category of technical assistance for real estate transactions, and includes the following key activities:
- Meetings and consultations with the Client
- Analysis of technical, administrative, and cadastral documentation
- Mortgage and cadastral checks and updates
- General preliminary inspection of the property’s current condition
- Optional assistance in identifying the counterparty
- Market research
- Urban planning and legal-technical consulting
- Price evaluation and negotiation support
- Assistance in drafting the terms and conditions of the transaction
- Drafting or review of the preliminary sale agreement or promise of sale
- Compilation of all technical, administrative, and cadastral documentation required for the notarial deed
- Assistance during the notarial signing
Additional Services
Given the increasingly complex regulatory landscape, Studio Scheel also provides:
- Verification of the validity and compliance of the Energy Certification (ACE and/or APE)
- Cross-checking of personal and property identification data between cadastral records and ownership titles
- Verification of consistency between the actual condition of the property and the cadastral plans/sheets, in compliance with Article 19, paragraph 14 of Legislative Decree no. 78 of May 31, 2010
- Detailed comparison between the actual condition of the property and urban/building documentation, including ownership titles
- Verification of the validity of the certificate of habitability, if available
- Assessment of the compliance of technological systems
- Verification of regular payment of administrative taxes (e.g., ICI, IMU)

Many of these services are also relevant under Art. 173 bis of the Italian Code of Civil Procedure in the context of judicial sales. Upon request, Studio Scheel can also provide:
- Clear and precise estimates of timeframes and costs for any necessary regularization procedures
- Detailed guidance on the timing and costs of ordinary or extraordinary maintenance works, new constructions, or extensions
- A breakdown of fiscal and tax burdens related to the transaction—an increasingly important aspect given the growing tax pressure on real estate and the anticipated cadastral reform

Studio Scheel operates with full independence from any economic interest in the transaction itself. Remuneration is strictly based on the technical services provided. The firm does not sell or promote any property, but rather verifies and safeguards the integrity of the entire process—acting solely in the interest of the Client, with full awareness of the value and responsibility of the technical services rendered.
Real Estate Due Diligence
Real estate due diligence is a critical process within the broader scope of property transactions. It consists of a detailed investigation into the condition and legal status of a property.
Imagine purchasing a home without knowing its structural integrity or potential legal issues—this could lead to serious financial consequences.
Due diligence provides a complete and detailed map of the property, enabling informed decisions and minimizing risks.
Technical Consultant (CTP)
The Party-Appointed Technical Consultant (CTP) is a professional figure of growing importance in civil proceedings. In many cases, the expert reports prepared by the CTP become the cornerstone of the entire trial, playing a decisive role—especially when the outcome of the case depends on the correct evaluation of highly technical matters.
For this reason, being represented by a CTP with appropriate skills and expertise is essential to ensure that one's arguments are acknowledged by the Court-Appointed Expert (CTU) and, ultimately, by the Judge, with the aim of achieving a favorable ruling.
Role and Responsibilities
The CTP is an expert appointed by one of the parties involved in the dispute, selected for their competence in a specific technical or scientific field relevant to the case. Acting in the interest of the appointing party, the CTP supports the CTU during their assignment by:
- Providing observations that support or challenge the CTU’s findings
- Drafting counterstatements and presenting independent conclusions
While operating, the CTP must adhere to their professional code of ethics and uphold principles of legality, integrity, and professional correctness. They must act autonomously and not be subordinated to the will of the legal counsel who appointed them.
Scientific Integrity vs. Legal Strategy
Although the CTP is appointed by one party, their technical work must not be “partisan.” The scientific foundation of their analysis must remain objective and cannot be tailored to fit a partial version of the truth.
It is important to note that the CTP is not a mere collector of evidence. Technical consultancy is not a means of proof—it serves to clarify the facts presented by the parties.
Ideally, the defense attorney should collaborate with the CTP, expressing legal needs to ensure the technical report aligns with the most relevant legal aspects. In turn, the CTP should inform the attorney of how scientific truth and legal strategy can be reconciled, fostering a mutual exchange of perspectives. Together, they present their partial view of the facts to the Judge.
CTU vs. CTP
In civil proceedings, the Judge may appoint a trusted expert—the Court-Appointed Technical Consultant (CTU)—to provide an impartial interpretation of the facts.
Unlike the CTU, the CTP:
- Is not required to take an oath
- May freely accept, refuse, or withdraw from the assignment at any time
